The distinction between the terms lies in the laws of that particular jurisdiction. Legality has to do with the detail of laws. There must be a formal command in writing, passed by legislative authority, such as local or national government, that makes it illegal. Illegal also has another common usage in English.

It is used when referring to the sanctioned rules of a game, such as football or soccer. On the other hand, something that is unlawful goes against the established law without there being a specific law that has been put into action or practice.

For example, you would get into trouble if you accidentally tossed a lit cigarette into a trash can, and it caught on fire, and there was damage. It may have indeed been an accident, but you still caused harm and endangered people who were nearby. Something illegal is prohibited, while something unlawful breaks the unspoken rules of society.

When you say unlawful, this is something that has not been authorized by law. It should be noted though that even if this is not really authorized, it is still not considered to be something that people should do. When you say illegal, this means that this is something that is already considered to be something that should not be done. When you say illegal, this means that there is a law that has been passed about it. There are a lot of people who may be doing things that are considered to be “unlawful.” People may know a bit that it is wrong but because there is no law that has been passed about it, people are still doing it anyway.

Legality has to do with the technicality and relevance of laws. There must be a specific law passed by legislative authority, such as a local or national government that formally and makes it illegal. The word illegal is also utilized when speaking of the formal rules of a game.

An example of a specific law that has been passed and is illegal is shoplifting. Shoplifting hurts the vendor selling the item, which cuts their income. Something unlawful goes against the established law, without there being a specific law passed by the legislative authority to condemn it. When we say illegal, we are referring to something that is not morally correct or something unjust.

Jaywalking, or crossing the middle of the street as opposed to walking in the designated walking area, for example, is considered to be unlawful. Something that is dangerous or goes against what is naturally right or correct is unlawful.

Some people may assume that illegal and unlawful are the same. When you say illegal, this means that this is forbidden by the law. When you do something that is illegal, there is a big chance that you will be caught, and there are consequences that may go with it.

When you say unlawful, this means that it may not be something that is unrecognized by the law. It may not be considered to be “good,” but since there is no law about this yet, there will be no legal issues that will arise from it.

For example, there may be some behavior that is considered to be unlawful, but there are no rules to state those things.

Illegal and unlawful are two terms that can be used interchangeably. They are mainly used in the legal field, to describe agreements or contracts. An unlawful agreement or contract can also be known to avoid contact. It differs from illegal because things that are unlawful are unable to be punished or honored by law. On the contrary, illegal agreements or contracts are enforced by law. Due to this, illegal contracts are void, while unlawful contracts are not illegal. A person that is involved in an illegal contract or agreement can be taken to court and be punished by law.
