Poker is illegal when it is played at home in some countries when people take a rake. This would still depend on where you currently live but it is not considered proper to take a rake from the poker table when the rake does not have the right permit to operate or the license in order to allow the game to commence.

If you are not familiar with what a rake is, this is a type of commission that is taken by the one who is allowing the game to take place. If people would play Poker at home or in private functions without a rake, then this will be okay. It only becomes illegal when a rake is already involved.

State laws defines any form of gambling as illegal but this excludes game played with cards at home with no persons making money, while in some other states playing cards and poker in public is highly regulated.

The game of poker itself is not illegal; it is the act of gambling based on the cards drawn that is illegal in certain places.

In the United States, as long as players are the only ones profiting from the game about half of all states provide an exemption in at home poker games. If a poker game involving gambling outside a licensed casino is at hand an illegal game of poker is considered an unlawful game under the Criminal Code Act of 1899 As long as players keep their game of poker legal and safe they will not be in any risk.

If an illegal poker game is witnessed based on non-authorizations, is played by one or more persons who gamble, the game is played out in public, is played in a place that occupies payment or money or percentage is not included in the winnings of the player. During at home games, nobody should accept any money, keep stakes small, know all players involved, cut the cards, play poker in a safe neighborhood, play with chips, and not cash, and if you do end up getting robbed, give the robbers the money and let the police handle the investigation.
